A Florida driver was arrested after a sheriff’s deputy deemed his rear window decal obscene and in violation of state disorderly conduct laws, sparking a legal battle over First Amendment protections.

Dillon Shane Webb was traveling through Lake City, Florida, when a Columbia County Sheriff’s deputy observed a sticker on his vehicle’s rear window. The deputy claimed the message violated state law regarding disorderly conduct and ordered Webb to remove it.

The Arrest

Webb refused to comply, asserting that the decal constituted protected speech under the First Amendment. The deputy arrested him on the spot, searched his vehicle, and transported him to jail.

The incident resulted in Webb spending a night in custody, being photographed for a mugshot, and facing legal charges stemming from the display of the sticker.

The Legal Challenge

Webb subsequently filed a lawsuit against the law enforcement agency, contending that no officer should possess the authority to criminalize speech based solely on its offensive nature. Legal experts have noted that courts typically protect such expressions under First Amendment jurisprudence.
